MEMBERSHIP OF THE SCOTLAND SUPPORTERS CLUB
TERMS AND CONDITIONS

 

TheScotland Supporters Club (“Supporters Club”) is organised by TheScottish Football Association Limited, a company registered in Scotlandand having its registered office at Hampden Park, Glasgow G42 9AY withcompany number SC005453 (the “Scottish FA”). Membership of theSupporters Club is governed by these terms and conditions (the “Termsand Conditions”) and these Terms and Conditions set out the terms of thecontract between Members and the Association. Please read them now. Ifyou do not comply with these Terms and Conditions your membership of theSupporters Club may be suspended or terminated.

Please note thatyour use of the Website to make an On-line Application is governed bythe Scottish FA’s Website Use Terms and Conditions, which apply inaddition to these Terms and Conditions


1. Definitions


Adult Member”means an individual aged between 16 years and 64 years who has paid theappropriate Membership Fee and has had his/her Online Application orTelephone Application for membership accepted by the Scottish FA tobecome a Member of the Supporters Club;

“Away Match(es)” means any International Match played outwith Scotland;


the Board” means the board of directors of the Scottish FA from time to time;


Chief Executive” means the Secretary of the Scottish FA appointed by the Board from time to time;


Full International Team” means the men’s association football team chosen to represent the Scottish FA at the highest international level;

 

Home Match (es)” means any International Match played at the National Stadium or other venue of equivalent size within Scotland;

 

International Match (es)” meansany international association football match or matches involving theFull International Team whether within or outwith Scotland;

 

Junior Member”means an individual aged 15 years and under who has paid theappropriate Membership Fee and has had his/her Online Application orTelephone Application for membership accepted by the Scottish FA to be aMember of the Supporters Club;

 

Member” means a member of the Supporters Club, being an Adult, Senior or Junior Member, as appropriate;

 

Membership Card”means the card that is issued to Members by or behalf of the ScottishFA for the duration of the Membership Period. This card will be used foridentification and loyalty purposes;

Membership Fee”means the sum of money specified on the Website required to be paid byan individual to accompany the Online Application required to securemembership of the Supporters Club for the Membership Period;

 

Member’s Pack” means goods and promotional offers exclusive to Members by or on behalf of the Scottish FA;


Membership Period”means the period of time, as prescribed by the Scottish FA from time totime, for membership of the Supporters Club. At the date of issue ofthe Terms and Conditions (November 2011), the Membership Period will beas specified in Clause 2.2;

 

National Stadium” means Scotland’s National Stadium, Hampden Park, Glasgow;


Online Application” means the method for any person to make an application to renew or join the Supporters Club;

 

Partner(s)” means a relevant, direct sponsor and/or partner of the Scottish FA whose services and/or information may be relevant to Members;


Points Criteria”means the criteria applied by the Scottish FA for allocation of ticketsto Away Matches based on the number of points awarded to the Member inaccordance with Clause 4.1;

 

Renewal” means the renewal of membership of the Supporters Club from one Membership Period to the next consecutive Membership Period; 

 

Scottish FA”means the Scottish Football Association Limited, a company incorporatedin Scotland under the Companies Acts with the registered number 5453and having its registered office at Hampden Park, Glasgow G42 9AY; 

 

Senior Member”means an individual aged 65 years and over who has paid the appropriateMembership Fee and has his/her Online Application or TelephoneApplication for membership accepted by the Scottish FA to become amember of the Supporters Club; 

 

Supporters Club”means the Scotland Supporters Club organised by the Scottish FA,membership of which is open to the general public subject to certainterms and conditions as amended from time to time;

 

Telephone Application” means the method of renewal of membership for Members without internet access;


Terms and Conditions” means the terms and conditions applicable to the membership of the Supporters Club as specified hereunder:

 

Website”means that part of the Scottish FA’s website operated by or on behalfof the Scottish FA for the purpose of enabling an individual to make anOnline Application to join the Supporters Club.


2. Membership

 

2.1 An individual shall become or continue to be a Member once theMembership Fee has been processed by or on behalf of the Scottish FA andan e-mail confirming completion of the membership application orrenewal, if appropriate, has been sent to the individual by the ScottishFA. Thereafter, the Member will be issued with a Member’s Pack and aMembership Card. A Member will be required to exhibit his/her MembershipCard to the Scottish FA, or any person acting on its authority, ondemand. The Membership Card shall remain the property of the Scottish FAand must be returned to the Scottish FA on demand. The Membership Cardmust be returned to the Scottish FA in the event of the membership beingterminated for any reason or the Member resigning his/her membership ofthe Supporters Club.


2.2 The Membership Period will be 1 January 2012 until 31 December 2013 inclusive.


2.3 Subject to Clause 2.1 above, applications for a Junior Member will onlybe accepted by the Scottish FA if it is connected to an application foran Adult Member or Senior Member who is the parent or guardian of theJunior Member and has previously been accepted during the MembershipPeriod.


2.4 It is a condition of membership that a Member acknowledges and agrees to abide by these Terms and Conditions.


3. Home Matches

 

3.1 Each Member will be invited to purchase one (1) ticket for his/her ownpersonal use for a Home Match. A Junior Member can only apply for aticket for a Home Match, if an accompanying Adult Member or SeniorMember also applies for a ticket for the same Home Match.


3.2 If Members want to attend matches with friends and family, they canapply for tickets for themselves and others, who must all be Members ofthe Supporters Club.


3.3 Any tickets remaining after a Members’ sale will be made available via a general public sale.


3.4 A Member will be awarded one point for attendance at a Home Match.


3.5 Any person, not being a Member, who has purchased tickets through ageneral public sale, will not be awarded points in accordance withClause 3.4, regardless of their attendance at the Home Match with aMember.


3.6 For Home Matches not being held at the NationalStadium the Scottish FA reserves the right, in its absolute discretion,not to issue a ticket or to issue fewer tickets than that applied for bythe Member.


3.7 For Home Matches being held at the NationalStadium, tickets will be issued to applicant Members on the basis asdetermined by the Chief Executive in his absolute discretion, and asnotified to Members from time to time, subject to the match terms andconditions under which the Home Match is being played.


3.8 For Home Matches not being held at the National Stadium, the issue of thetickets is subject to availability. The means of allocation of suchtickets shall be determined by the Scottish FA from time to time in itsabsolute discretion.


3.9 For Home Matches, ticket that are lost in the postal system will not be replaced.


3.10 Junior Members under the age of 16 years will not be admitted to thevenue without being accompanied by an Adult Member or Senior Member.


4. Away Matches

 

4.1 A Member may apply to purchase one (1) ticket for his/her own personaluse for any Away Match. A Member will be awarded one point forattendance at an Away Match. Away Points will not be awarded for ticketsreceived via any other source.


4.2 Any person, not being a Member, will not be invited, nor entitled, to apply for a ticket for an Away Match.


4.3 The issue of the tickets for any Away Match is subject to theavailability of tickets made available to the Scottish FA. The ScottishFA reserves the right, in its absolute discretion, to refuse anallocation of tickets from any other national football association forany reason including, without limitation, on grounds of safety andsecurity.


4.4 In the event of an over subscription of demandfor an Away Match, the Scottish FA will use the Points Criteria andallocate tickets to Members in order of most attendances from the lastten (10) Away Matches. Thereafter, if the number of Members on equalpoints is more than the number of tickets remaining, tickets will bedistributed on a “first come, first served” basis by reducing pointslevel until all remaining tickets are allocated.


4.5 Ticketswill be issued for Away Matches at the absolute discretion of theAssociation. The Scottish FA reserves the right not to issue a ticket orto issue fewer tickets than that applied for by the Member.

 

4.6 Tickets will be issued to applicant Members for the Away Match inquestion on the basis as determined by the Chief Executive in hisabsolute discretion and as notified to Members from time to time,subject to the match terms and conditions under which the Away Match isbeing played.


4.7 A Junior Member can only apply for a ticketfor an Away Match, if an accompanying Adult Member or Senior Member alsoapplies for a ticket, in accordance with Clause 2.3 above. The name ofthe Adult Member or Senior Member must be supplied at the time ofapplication by a Junior Member for a ticket.


4.8 The issuing of an Away Match ticket is conditional on each Member producing to theScottish FA copies of valid travel documentation as may be notified bythe Scottish FA from time to time.


4.9 It may be necessaryfrom time to time for a Member to collect their Away Match ticket locally in the city where the Away Match is taking place. The ScottishFA will advise each Member where to collect their ticket in advance ofthe match kick off time and they will be asked to present theirMembership Card or a valid Passport for identification purposes before a ticket will be issued.


4.10 If a Member does not collec ttheir Away Match ticket and does not advise the Scottish FA, or such person authorised by the Scottish FA, prior to the match kick off timethat he/she will not collect the ticket nor attend the match, that Member’s membership to the Supporters Club may be suspended or terminated by the Scottish FA forthwith with no refund payable.


4.11 An Away Match point will not become active until 2 weeks after the Away Match has taken place and, as a result, will not be considered for an other Away Match within this period.


4.12 For Away Matches,all ticket cancellations must be received by the Scottish FA in writing before the Away Match has kicked off. In this event, a refund will only be issued if the Scottish FA is successful in selling the ticket to another Member.


5. Payment

 

5.1 A Memberwill be required by the Scottish FA to submit the Membership Fee bycredit or debit card to the Scottish FA or to such third party soauthorised by the Scottish FA and/or in advance of payment for a ticketfor an International Match. The Member will be notified as to the amount of Membership Fee via the Online Application or as to the purchase price of tickets, which will be taken from his/her credit or debit cardaccount. If the Member defaults in payment of any amount due to the Scottish FA, the Scottish FA reserves the right, in its absolute discretion, to refuse, suspend or withdraw membership to the SupportersClub until the payment is made in full and/or not to issue tickets until payment is made in full. During this period, any rights andentitlements of the Member relating to the Supporters Club are suspended.


5.2 Tickets are issued by the Scottish FA for use by the named Member only. Members are expressly prohibited from disposing of, re-selling or transferring any tickets that have been allocated to them. Failure to comply with this obligation may result in the membership being suspended or terminated as determined by the Scottish FA, in its absolute discretion.

 

6. General

 

6.1 Only private individuals can be Members of the Supporters Club.


6.2 Membership of the Supporters Club is not transferable.


6.3 A Member may resign membership by returning his/her Membership Card to the Scottish FA at its registered office at any time.


6.4 The Membership Fee will only be refunded by the Scottish FA as the Scottish FA determines in its absolute discretion from time to time.


6.5 A Member found to have supplied false and/or misleading information inhis/her application form will have his/her membership terminated forthwith with no refund payable.


6.6 The Scottish FA reservesthe right, in its absolute discretion, to refuse membership to the Supporters Club or expel from membership any person convicted in the United Kingdom or elsewhere:


(a) for any football related offence; or
(b)for any other offence involving conduct which in the opinion of the Scottish FA is not conducive to the promotion of football or which may bring the Association and the Supporters Club into disrepute.
 

6.7 The Scottish FA may take such action, as it considers appropriate in relation to the membership of a Member. In particular, the Scottish FA may suspend or terminate the membership of any Member considered to have breached the Terms and Conditions by giving such Member notice inwriting of such suspension or termination. The decision of the Scottish FA shall be final and binding in all respects.
 

6.8 TheScottish FA reserves the right to amend, suspend or add to the Terms and Conditions at any time, as it deems appropriate in its absolutediscretion, subject to notice in writing or by e-mail to the Members.


6.9 The Member agrees and acknowledges that personal details provided tothe Scottish FA both during the Online Application and otherwise will be used by the Scottish FA in accordance with the Scottish FA’s Privacy Policy and processed by the Scottish FA in accordance with all relevant Data Protection legislation.

In particular, the Scottish FA will use the information of Members and Junior Members to:-

 

• provide the Member with the services and information requested;
•to analyse the information so that the Scottish FA can administer,support and improve and develop its business and the services it offers;
• to contact Members in order to send details of the Scottish FA’s goods and services which may be of interest;
• to provide Members with access to certain parts of the Scottish FA’s Website;
• for all other purposes consistent with the proper performance of the Scottish FA’s operations and business; and
• to contact Members for their views on the Scottish FA’s and/or its Partners’ products and services.

 

7. Jurisdiction

 

7.1 The Terms and Conditions shall be governed by and construed inaccordance with the Laws of Scotland and any disputes that may arisewill be subject to the exclusive jurisdiction of the Scottish courts.
