A Disciplinary Tribunal convened on 1 June in accordance with the Judicial Panel Protocol to consider the following case:
Alleged Party in Breach: Henry McClelland (Annan Athletic Football Club Chairman)
Disciplinary Rules allegedly breached:
Disciplinary Rule 22: In that between 1 July 2011 and 30 June 2012, both dates inclusive, you placed bets upon football matches in contravention of Disciplinary Rule 22 of the Scottish FA’s Disciplinary Rules for Season 2011 / 2012 in that:
i) You placed a total of 226 bets upon football matches; and/or
ii) That of that total of 226 bets placed upon football matches 40 bets were placed which featured bets placed upon matches in which your own club was playing; and/or
iii) That of those 40 bets which featured bets placed upon matches in which your own club was playing 1 accumulator bet was placed which featured a bet placed against your own club.
Disciplinary Rule 22: In that between 1 July 2012 and 30 June 2013, both dates inclusive, you placed bets upon football matches in contravention of Disciplinary Rule 22 of the Scottish FA’s Disciplinary Rules for Season 2012 / 2013 in that:
i) You placed a total of 745 bets upon football matches; and/or
ii) That of those 745 bets placed upon football matches 97 bets were placed which featured bets placed upon matches in which your own club was playing; and/or
iii) That of those 97 bets which featured bets placed upon matches in which your own club was playing 2 bets were placed, including an accumulator bet, which featured a bet placed against your own club.
Disciplinary Rule 33: In that between 1 July 2013 and 30 June 2014, both dates inclusive, you placed 750 bets upon football matches in contravention of Disciplinary Rule 33 of the Scottish FA’s Disciplinary Rules for Season 2013 / 2014 in that
You placed a total of 750 bets upon football matches; and/or
That of those 750 bets placed upon football matches 96 bets were placed which featured bets placed upon matches in which your own club was playing
Disciplinary Rule 31: In that between 1 July 2014 and 30 June 2015, both dates inclusive, you placed bets upon football matches in contravention of Disciplinary Rule 31 of the Scottish FA’s Disciplinary Rules for Season 2014 / 2015 in that:
i) You placed a total of 964 bets upon football matches; and/or
ii) That of that total of 964 bets placed upon football matches 68 bets were placed which featured bets placed upon matches in which your own club was playing; and/or
iii) That of those 68 bets which featured bets placed upon a match in which your own club was playing 1 accumulator bet was placed which featured a bet placed against your own club.
Disciplinary Rule 31: In that between 1 July 2015 and 30 June 2016, both dates inclusive, you placed 1033 bets upon football matches in contravention of Disciplinary Rule 31 of the Scottish FA’s Disciplinary Rules for Season 2015 / 2016 in that:
i) You placed a total of 1033 bets upon football matches; and/or
ii) That of those 1033 bets placed upon football matches 90 bets were placed which featured bets placed upon matches in which your own club was playing.
Disciplinary Rule 31: In that between 1 July 2016 and 1 May 2017, both dates inclusive, you placed 293 bets upon football matches in contravention of Disciplinary Rule 31 of the Scottish FA’s Disciplinary Rules for Season 2016 / 2017 in that:
i) You placed a total of 293 bets upon football matches; and/or
ii) That of those 293 bets placed upon football matches 39 bets were placed which featured bets placed upon matches in which your own club was playing.

• Breach of Disciplinary Rule 22 - Season 2011 / 2012 & 2012 / 2013
• Breach of Disciplinary Rule 33 - Season 2013 / 2014
• Breach of Disciplinary Rule 31 - Season 2014 / 2015, 2015 / 16 & 2016 / 17
Sanction:
The Tribunal imposed a £3,000 fine: £1,000 payable within 30 days of the hearing date and £2,000 suspended until the End of Season 2017/2018 and to take effect only in the event that Henry McClelland is found in breach of Disciplinary Rule 31, or any other Disciplinary Rule of the Scottish FA relating to gambling upon football, at any time during that time period.
