Appellate Tribunal | Gerry Strain
Appellant: Gerry Strain
Appellate Tribunal Hearing date: Wednesday, 10 December 2025
Appellate Tribunal Information: A Preliminary Hearing in terms of paragraph 17.8.2(e) of the Judicial Panel Protocol was convened to determine whether in terms of paragraph 7.2.1(b) of the Protocol the Judicial Panel has jurisdiction to determine an appeal by the Appellant against a decision of the Respondent under Article 10(3) of the Articles of Association of the Scottish Football Association.
Appellate Tribunal Outcome: It was concluded that the Articles of Association and the Judicial Panel Protocol do not allow a right of appeal to the Judicial Panel in respect of a decision of the Respondents regarding whether a person is a fit and proper person to hold a position within Association Football in terms of Article 10.3 of the Articles of Association. Nor does the Appellate Tribunal consider that a right of appeal to the Judicial Panel can be implied. The decision of the Appellate Tribunal is that the Judicial Panel does not have jurisdiction.
